我国外资国民待遇法律实践的若干认识

Some Ideas on Legal Practice of Chinese National Treatment to Foreign Investment

当前我国对外资国民待遇问题的研究,存在着追求发达国家所要求的全面国民待遇之倾向,由此也导致了对国民待遇认识上的偏差以及对我国外资待遇法律实践的不客观评价。本文以为,我国已经给予了外资国民待遇,现在所要做的只是将这个事实法律化而已。

In studying the Chinese national tre atment to foreign investment,peopl e tend to seek all -round national treatment required by developed cou ntries.Such tendency results in the deviations of understanding for national treatment and unobjective appraisa l of China' s legal practice.It is believed in th is paper that China has granted national treatment to forign investment,and what needs to be done now is t o legalize the fact.
