全球规则重构背景下中国自贸协定范式论纲——托马斯·库恩经典理论的视角借鉴

A Compendium for the Paradigm of China’s FTAs Under the Background of Global Rule Reconstruction——References from Thomas Kuhn’s Classic Theory

后金融危机新时期全球经贸规则正在发生显著变革,在变革主体、变革内容、变革舞台等方面展现出不同以往的系列特征。自贸协定已悄然崛起为规则重构的中心舞台。作为发展中大国与新兴经济体的中国,其自贸协定范式的研究意义得以凸显。为此,有必要借鉴科学史上库恩经典的范式理论,分析中国国际经济法理论范式下中国自贸协定面对的一系列新问题。中国国际经济法学科传统理论范式绝不过时,但需要在自贸协定实践问题上做出及时的认识调整,以适应当下中国国家身份和利益的变迁现实。中国自贸协定应更加鲜明地突出自身利益点,形成相对稳定的议题结构和规则模板。这对于中国维护发展中大国利益、进而推进国际政治经济新秩序具有重要战略意义。

In the new era of post-financial crisis,the global economic rules are experiencing a significant change,which exhibits a series of features different from before on the subjects,contents and arenas of change.Free trade agreements have quietly emerged as the central stage of the rule reconstruction.As China being a developing power and emerging economy,the significance of the study of its FTAs has been highlighted.Tothis end,it is necessary to get reference from the classic paradigm theory of Kuhn in the science history,then analyze a series of new problems faced by China’s FTAs under China’s theoretical paradigm of international economic law.The traditional theoretical paradigm of international economic law in China is never out of date,but needs to make timely adjustments on the issues of the practice of FTA,thus to adapt to the changing reality of China’s current national identity and interests.China’s FTA should be more prominent in highlighting its own interests,form a relatively stable issue structure and rule template.This is of great strategic significance for China to safeguard the interests of a developing power and promote the new international political and economic order.
