国际法具有法的一般特征与作用,但对于全面描绘、刻画与理解国际法而言,这还不够。从工具主义视角出发,深刻认识国际法所具有的无政府状态、现实主义、初级阶段和以西方文明为主导的四大特征,并分析它在国际社会中的进攻作用、防御作用、惩罚作用和形象塑造作用,可以从另一个侧面了解国际法在真实世界中的运行,避免因国际法乌托邦而带来不切实际的幻想,以便在充分评估的基础上切实把握和运用国际法,力助中国和平发展战略的实现。

International law has characteristics and functions the same as that of law.However,It is not enough for us to comprehensively describe,depict and understand international law.From the perspective of instrumentalism,we can find that anarchy,realism,primary stage and dominated by western civilization are the four important characteristics of international law,and international law has the functions of attacking,defensing,punishing and image-building.Knowing these characteristics and functions,it is useful to understand how international law works in the real world and to avoid falling into the phantom of a international law Utopia.Accordingly,we can grasp and utilize international law on the bases of correct evaluation to give supports to the achievement of Chinese peaceful development strategy.
