离婚诉讼证据规则适用问题研究——以Y市法院135份离婚判决书为分析样本

On Evidence Rules’ Application in Divorce Litigation:A Sample Study of 135 Divorce Decrees in Court of Y City

离婚诉讼作为家事诉讼的重要类型,具有家事诉讼相交叉的特点,且注重追求案件的客观真实。在现行的民事诉讼模式下构建的证据规则难以全面适应离婚案件的特点,不能适应家事审判改革要求。有鉴于此,对当事人处分权进行适当的干预、采取一定的职权探知、强化法官的自由心证以及合理分配离婚诉讼中双方当事人的举证责任,进而建构符合离婚诉讼特殊性的证据规则,保障离婚案件中妇女、未成年人的合法权益,促进实质公平。

As an important type of family litigation,divorce litigation has the characteristics of family litigation and pursues objective truth of the case.The evidence rules established under current civil litigation mode are difficult to adapt to the characteristics of divorce cases and thus fail to meet the requirements of family trial reform.In order to protect the legitimate rights and interests of women and minors in divorce cases and promote the substantive fairness,we should appropriately intervene in the parties’right of disposition,use the court’authority to obtain evidence,strengthen the judge’s free evaluation of evidence,reasonably distribute the parties’burden of proof in divorce litigation,as well as establish evidence rules consistent with the particularity of divorce litigation.
