清末轮船招商局的中外海事纠纷案件

The China Merchants’ Steam Navigation Company and the Sino-foreign Maritime Disputes in Late Qing China

摘要 本文从清末轮船招商局船舶碰撞和地权纠纷案例看早期中外民商事案件中的法律管辖权冲突问题。本文讨论了轮船招商局'利运'轮撞沉宁波商船案、'福星'轮被英国怡和洋行'澳顺'轮撞沉案和招商局所涉地权纠纷案等三个案例。清政府在处理以招商局为代表的中国企业同外商间海商事纠纷中,虽然国家司法主权受到外国冲击,但仍做出了一定的积极尝试,促进了清末商法移植、对外国诉讼制度的学习和对国际立法的积极参与。 In late Qing China, there were many legal disputes on steamship and junk collisions and land title disputes. This chapter uses "Lee Yun" hinted Ningbo sank case,"Fuxing" Jardine case and a land dispute case to discuss early Chinese and foreign legal jurisdiction with regard to civil and commercial conflicts. All these three cases involved the China Merchants’ Company. Although China lost national judicial sovereignty after Opium War, the Qing Government made aggressive attempts to introduce Western law systems into China. This learning process also illustrates the process of active participation in introducing international legislation and China’s early efforts of adopting maritime law.
