WTO争端解决机制的改革谈判和我国的因应策略

The Reform Negotiations on the Post-Cancun WTO Dispute Settlement Mechanism and China’s Countermeasures

多哈回合坎昆第五次部长会议后,WTO成员继续就改革WTO争端解决机制进行谈判。本文在DSU的基础上剖析了WTO争端解决机制的五个主要问题,并分析了DSU的条款,考察了来自各个WTO成员的建议,同时结合1995年以来WTO争端解决案例,以及专家组和上诉机构的司法解释,提出了我国在多哈回合中就WTO争端解决机制改革问题的因应策略。

The WTO members continue to review DSU after the 5th Ministerial Conference in Cancun.This paper highlights the five major problems of the WTO dispute settlement mechanism based on the DSU.It discusses critically these problems by examining the DSU provisions,various proposals from the WTO members for improving the DSU,statistics on the WTO cases of dispute settlement,and the judicial interpretations of the Panels and Appellate Body since 1995.This paper also makes some suggestions to China concerning the improving WTO dispute settlement mechanism during the Doha Round.
