'美国钢铁保障措施案'是中国在WTO的第一案,也是WTO有史以来最大、最复杂的案件。本案历经21个月,经过了WTO争端解决机制规定的主要法律程序,包括磋商、专家组裁决、上诉机构审议。WTO最终裁决,美国采取的保障措施不符合WTO规则。最后,美国宣布取消该措施。本文对该案的始末作了比较全面的介绍,包括美国措施的具体内容,美国采取该措施的原因及影响,本案的法律程度,中国参与该案的情况,专家组和上诉机构裁决的特点。在本文最后,还对保障措施和WTO争端解决机制提供了一些评论。

United States Definitive Safeguard Measures on Imports of Certain Steel Products is the first WTO case for China since its accession to the WTO in 2001.The dispute also proved to be the largest and most complicated to be heard by a WTO panel.In 21 months,the case experienced the different stages of the WTO dispute settlement procedures,including consultations,panel and appellate reviews,which led to a final determination by the Appellate Body that the US measures are inconsistent with the WTO rules.The case ended with the termination by the US president of the disputed measures.This article traces the whole history of this case,describing the US measures,the causes and effects of the measures,the legal procedures,China’s participation,and analysis on the panel and Appellate Body reports.In the end of this article,some comments are made on WTO safeguards and dispute settlement mechanism.
