The Principle of Sustainable Development:A Legal Foundation for the Harmonization of Trade and Environmental Policies Under WTO

20世纪70年代以来,全球性的环境问题日趋严重,并对多边贸易体制提出了挑战。WTO建立后,多边贸易政策和环境政策的协调问题摆在了WTO的面前,环境问题也成为多哈回合的一个新议题。本文拟从'可持续发展原则'的视角,来探讨WTO贸易与环境政策的协调问题,并对'可持续发展原则'的法理内涵和国际法意义进行了阐释,提出'可持续发展原则'作为WTO贸易与环境政策协调的法律基础的理论和现实依据。

Since 70’s last century,the serious global environmental problems strongly challenge the multilateral trade system.It is a real task for WTO to harmonize its trade policy with environmental policy.Trade and environment become an update agenda in Doha Round.This article focuses on the issues on the harmonization of trade and environment policies under WTO,especially in the view of sustainable development.The article also analyses the legal meaning of the sustainable development and takes the principle of sustainable development as the legal foundation for the harmonization of the trade and environment policy under WTO.
