Economic Thought of Hayek and the Development of International Economic Law in the Background of Globalization

新自由主义的兴起与传播对于晚近经济全球化起到了很大的促进作用,而该学说的奠基人物哈耶克的经济思想对于晚近国际经济立法的勃兴也具有一定的解释功能。本文首先对以哈耶克为代表的新自由主义理论的兴起与全球传播作了简要概述;并依据哈耶克经济思想的主要观点,对晚近国际经济立法的内容建构以及存在的问题进行了详细解释;最后,本文就新自由主义对国际经济立法的影响及解释功能作了简要评估与预测。

The emergence and spread of neo-liberalism accelerated the recent economic globalization.The economic thought of Hayek,who is the founder of this school,can be helpful in explaining the recent development of international economic legislation.This article first reviews the emergence and spread of neo-liberalism represented by Hayek,and then explains in detail the content and flaws of recent international economic legislation.Finally,this article makes a brief evaluation and prediction of the influences of neo-liberalism on international economic legislation.
