摘要
《北美自由贸易协定》的争端解决机制保障了协定效力的有效发挥,其分设的争端解决机构、多重的争端解决法律渊源、有差别的争端解决程序与执行方式以及私主体的不同参与方式等使其呈现出分散型的特点。NAFTA争端解决机制的相关做法值得WTO借鉴。
The dispute settlement system of NAFTA guarantees the effect of the Agreement to exert effectively,and its dispersive character,which also sets a good example for WTO,results from its multiplex dispute settlement boties,extensive legal resources,diverse dispute settlement procedures and performance manners,different ways of the participation of private parties and so on.
