任人唯贤,还是任人唯亲——WTO上诉机构成员选任的规范与实践考察

Appointing People by Favoritism or on Their Merits—A Study on the Rules and Practices of the Appointment of WTO Appellate Body Members

WTO争端解决机制的成功很大程度归功于WTO上诉机构的高效和独立运作。本文首先考察上诉机构成员遴选规则,其次回顾上诉机构初次选任过程和有关WTO成员方的利益争斗,在此基础上,从任人唯贤及任人唯'亲'两个方面分别及综合考察上诉机构成员的选任过程,较深入地反映了有关WTO成员方政治考虑在选任上诉机构成员过程中的影响。此外,本文还针对中国在参与上诉机构成员选任过程中面临的问题及对策作了分析。

The success of the WTO Dispute Settlement Mechanism greatly attributes to the efficient and independent operation of the Appellate Body(AB).This paper firstly reviews the WTO rules on selecting AB members,and then investigates the processes of and the interests-related contentions during the initial selection of the AB members.On this basis,this paper goes on to analyze the merits and origins of the appointed AB members,and in-depth reveals the influences of political considerations of some powerful WTO members on the selection and appointment of the AB members.Besides,this paper also briefly analyzes some practical problems facing China and proposes some corresponding policies,which might be taken to China under the current WTO regime.
