摘要
晚近,国际投资协定在双边、区域和区域间的层面上均得到进一步发展,构成了日益复杂的多层次、全方位的国际投资规则框架。本文从双边投资协定、避免双重征税协定、贸易与投资优惠协定及国际投资仲裁等四大方面阐述20世纪90年代以来国际投资规则制定的发展趋势及显著特征。
The past few years saw an intense proliferation of International Investment Agreements at the bilateral,regional and inter-regional levels.Such proliferation has resulted in an increasingly complicated framework of multi-layered and multi-faceted investment rules.In this article,the author articulates main trends and salient feature of in international investment rule-making since 1990s from the perspectives of BIT,DDT,PTIA and international investment arbitration.
