全球化语境中的跨国社会立法刍议

The Transnational Social Legislation in the Context of Globalization

晚近,经济与技术的全球化愈益显现社会'导向',而社会立法也面临着'全球化'的前景。与此同时,国际社会的传统国家间体系与全球市民社会之互动也为各类行为体循着跨国法路径构造全球社会立法提供了现实条件。跨国社会立法脱胎于行之久远的社会立法理论与实践,有其自身独特的社会功能、价值诉求和结构特征。当前的跨国社会立法不仅体现在各国单边立法层面,还体现在传统'国家间'立法和新兴全球市民社会的规则丛林中。但是,囿于国际体系现实的惯性和社会立法自身的复杂性,跨国社会立法的发展路径将迂回曲折,其在模式选择上则须着眼于与人权、主权和治理理念的契合。

The recent developments of economic and technologic globalization become more and more social oriented,which entails the necessity of globalization of social legislation.Meanwhile,the interaction between traditional intergovernmental regime and global civil society pave the way for all kinds of entities to construct global social legislation along the transnational paradigm.The transnational social legislation derives from the well established theory and practice of social legislation in various countries while having its own special characters in social function,intrinsic value and structure.The current transnational social legislation is not only embodied at the unilateral level but also at the intergovernmental level and global civil society level.However,with the restrictions from the reality of the international society and the complicacy of social legislation,the road ahead for transnational social legislation is bumpy.It is well advised to take the human right,sovereignty and governance theory into consideration while looking forward to the way out.
