Bilateral Safeguard Measure of NAFTA and Lessons for China

双边保障措施制度是区域贸易协定特有的一项贸易救济制度。本文首先对双边保障措施制度的含义予以澄清,之后选取最具代表性的NAFTA双边保障措施制度进行深入研究,最终找出了现有中外自由贸易协定双边保障措施制度的不足,提出构建未来中外区域贸易协定双边保障措施制度的设想。本文建议:未来中外区域贸易协定应借鉴NAFTA的相关规定,从严规范双边保障措施制度。

The system of bilateral safeguard measure is a special trade remedy measure in regional trade agreements.This article firstly clarifies the concept of bilateral safeguard measure;then analyses the most representative NAFTA bilateral safeguard measure system;and finally finds out the deficiencies of bilateral safeguard measure system in existing free trade agreements between China and other countries.This article also provides some suggestions on how to build bilateral safeguard measure system in China’s future regional trade agreement;learn from the provisions of the NAFTA and strictly regulate bilateral safeguard measure system.
