摘要
指定银行在跟单信用证支付中具有重要作用。《跟单信用证统一惯例》有关指定银行的规定有失偏颇,显失公平。本文以UPC600为基础,解析指定银行的种类和责任,并联系我国法院判例,提示相关风险和问题。
The nominated bank plays a significant role in the payment of documentary letters of credit.However,relevant provisions regarding nominated banks under UCP(UCP Uniform Customs and Practice for Documentary Credits)has always been onesided and unfair.Based on UCP600,this article analyses the various categories and liabilities of nominated banks and outlines relevant risks and issues on the basis of Chinese court decisions.
