本文首先从对仲裁庭管辖权的审查、临时保全措施、撤销仲裁裁决和执行仲裁裁决四个方面阐述中国司法对仲裁的支持和监督,继而通过一起我国法院拒绝承认与执行国际商会仲裁院裁决案,分析目前中国司法对仲裁的支持与监督态度,为司法与仲裁正确关系的完善提出一些建议。

This article first elaborates the support and supervision Chinese judicature renders to arbitration,in aspects of the review of arbitral tribunal's jurisdiction,interim measures of protection,removal of arbitral awards and enforcement of arbitral awards.Then,taking a recent case refusing the recognition and enforcement of an ICC award as an example,it analyses the support and supervision attitude of Chinese judicature to arbitration at present in order to provide reference for the improvement of the relationship between judicature and arbitration.
