非贸易规范与WTO规范的根本冲突:政策及政治基础

The Fundamental Conflicts between Non-trade Norms and WTO Norms:Policy and Political Foundation

由于非贸易制度对经济、贸易的管制特性,非贸易规范与WTO规范所追求的政策目标存在根本的冲突,而且非贸易规范如果适用于WTO框架中,还会动摇WTO体制的政治基础,从而威胁到WTO的生存与发展。本文认为,鲍威林等学者建议将非贸易规范概括地引入WTO进行适用,以解决WTO与非贸易问题的冲突是错误的。

Because of the regulatory feature of non-trade norms,they fundamentally conflict with the very policy of free trade pursued by the WTO.Furthermore,if non-trade norms are to be integrated into WTO automatically,they will undermine the political foundation upon which the WTO was created.The suggestion made by Pauwelyn and other like-minded scholars to bring non-trade norms into WTO to resolve the conflict between WTO and the non-trade topics is wrong.
