China's Industrial Policy and WTO Law

如何协调国内产业政策与WTO法之间的矛盾是WTO新成员面临的挑战。WTO法是否真的忽视了一些新成员的发展诉求?是否应当为发展中国家'松绑'?本文以中国汽车产业政策为例,分析了中国入世后如何重新制订汽车部门的产业政策,以协调国内汽车产业政策与WTO法之间的关系。本文认为,新成员应当在现行的WTO规则和其入世具体承诺的约束之下重新制订其国内产业政策,而不赞同为发展中国家放宽WTO法的主张。

A challenge for new WTO member is how to reformulate its development strategy within the WTO law framework without violating its WTO commitments.It gives rise to the question as to whether the WTO ignores some new member's development and whether WTO law should be more lenient for developing countries.This article analyzes how China has managed to meet this challenge after its accession to the WTO,and how China has reformulated its industrial policy for automobile sector.This article takes the position that new WTO member should seek to reformulate its industrial policy within the WTO law framework without violating its WTO commitments.
