摘要
2011年9月,我国台湾地区与日本分别透过各自民间团体签署'投资协议',这是自两岸签订《海峡两岸经济合作框架协议》之后,我国台湾地区与其主要贸易伙伴签署的第一个促进与保护投资的双边安排,在缔约主体、缔约名称和缔约内容等方面具有区别于传统双边投资条约的非典型特征,而此间祖国大陆官方沉默的态度也蕴含着丰富的法律与政治逻辑。该协议不仅反映了我国台湾地区有限的法律地位,也体现了我国台湾地区试图扩大对日实质关系的法律策略,并考验着两岸的政治互信程度。
In September of 2011,through their respective non-governmental organizations,the Taiwan authority and Japanese government signed a bilateral investment arrangement.It is Taiwan's first bilateral document with its major trading partner on the protection and promotion of bilateral investment after the Cross-Strait Economic Cooperation Framework Agreement.Different from traditional bilateral investment treaties,this arrangement has its own characteristics with regard to the contracting party,the title as well as the content of the arrangement.Furthermore,Chinese government's si-lence to this arrangement also contains legal and political implications.The conclusion of the arrangement not only reflects the limited legal status of Taiwan,but also reflects Taiwan's legal strategy to expand its substantive relations with Japan;therefore,the mutual trust between the Cross-Straits governments faces an imminent test.
