The Libya conflict raised the issue of protection of investment in situations of armed conflict,of which the applicability of bilateral investment treaties(BITs)is no doubt a very important dimension. This article firstly discusses common clauses in BITs that are related to armed conflict, and analyses the applicability of BITs that contains such clauses. It then moves to examine the applicability of BITs without such clauses, according to the general rules of the law of treaties. Finally, the article examines the applicability of BITs and the responsibility for breaches when an anti-governmental armed group achieves final success and establishes a new government.
