Waking America Up: An Analysis of Unilateral U. S.Trade Remedies against China

随着特朗普总统上台,近期美国对华贸易政策逐步体现出单边主义的特点。美国单边对华发动301调查不仅违反WTO《关于争端解决规则与程序的谅解》第23条,而且严重违背程序正义与实体正义。本质上,美国正大力推动中美经贸摩擦转变为中美制度摩擦。然而,美国单边贸易救济措施必须受多边贸易机制的约束。实际上,多边贸易体系明确认可多元化的市场经济体制。因此,中国应坚持以多边贸易机制为基础纠正美国的错误认识,坚持本着互利共赢的理念解决超WTO义务问题,并坚定不移地推动形成全面开放新格局,以此应对美国单边主义的挑战。

As Donard Trump becomes the U.S.President,the U.S.trade policy towards China has gradually reflected the characteristics of unilateralism.U.S.unilateral 301 investigation against China not only violates Article 23 of the WTO Dispute Settlement Understanding,but also seriously violates procedural and substantive justice.In essence,the United States is vigorously advocating the potential clashes between China and U.S institution.However,U.S.unilateral trade remedy measures must be bound by multilateral trade rules.In fact,the WTO law recognizes a diversified market economy system.In order to curb U.S.unilateral trend,China shall correct the U.S.misunderstanding on the basis of the multilateral trade rules,and adhere to the principle of mutual benefit to solve WTO-plus issues,as well as to guarantee the reform and opening-up policies.
