Common Development: The Initiative on the Bilateral Investment Treaty Practice between China and “One Belt One Road” States

在简述'一带一路'国际合作法制背景的基础上,本文探讨中国与'一带一路'国家之间BIT实践目标、模式和内容的创新问题。本文认为,'投资保护—投资自由化'是传统BIT实践目标的演进轨迹,'可持续发展'是BIT实践目标的新倡议,而'共同发展'可作为中国与'一带一路'国家之间BIT实践的创新目标;在传统BIT实践模式基础上,中国与'一带一路'国家可借鉴和汲取'可持续发展导向'BIT实践模式的创新因素,通过BIT结构和条款的革新和改造,创造'共同发展导向'BIT实践模式;在既有BIT'国际话语体系'内,中国与'一带一路'国家可通过'共同发展'条款的引入、传统条款的'扬弃'和创新条款的采纳,实现对传统BIT实践内容的改革,形成服务于'共同发展导向'BIT实践的内容。

Based on the introduction to the legal background on the international cooperation of the'One Belt One Road',the author studies the issues on initiative for purposes,models and contents of bilateral investment treaty(BIT)practice between China and the'One Belt One Road'states.The author indicates that'investment protection—investment liberalization'is the evolution path of traditional purposes of BIT practice,the'sustainable development'is a new suggestion for the purpose of BIT practice,and the'common development'shall be the initiative for the purpose of BIT practice between China and the'One Belt One Road'states;on the traditional model of BIT practice,China and the'One Belt One Road'states shall learn from innovative elements of'sustainable development oriented'BIT model,create the'common development oriented'BIT model by innovation and reconstruction on the structure and articles of BITs;in the existing'international discourse system',China and the'One Belt One Road'states shall make innovation on the contents of traditional BIT practice by introduction of'common development'provisions,develop-discard of traditional provisions and adoption of innovative provisions,and bring about the new contents serving the'common development oriented'BIT practice.
