试论行政道德的规制功能与实现

ON THE BINDING FORCE FUNCTIONS OF ADMINISTRATIVE MORALITY

行政主体及公务员的行政行为选择需要行政道德的规制 ,而行政道德的规制功能根本在于约束行政主体及公务员的行政行为选择。同时 ,它对公民法人或其他组织也具有示范和影响的功能 ,对整个国家行政管理还具有维系的功能。行政道德规制功能实现的主要方式为行政义务、行政良心、行政价值目标 。

The behaviours of the body of administration should be restraind by adminisitrative morality. Administrative morality functionslie in binding and monitoring the behaviours of the body of administration, the civil juridical persons and some other organizations. Meanwhile, they maintain the administrative management of our nation. The binding force of administrative morality is manifested by three principles--administative obligation, administrative conscience and aim of administrative value. However, the key to the realization of administrative morality is to construct a favorable moral environment.
