Analysis of the Preservation of the Goods in the United Nations Convention on Contracts for the International Sale of Goods(1980)

研究《联合国国际货物销售合同公约》(以下简称《公约》)规定的买卖双方对货物的保全义务对国际货物贸易实践和理论研究均有重要的意义。本文分成四个部分,前三个部分通过对现有研究的讨论,阐明《公约》规定的货物的保全义务的内容,第四部分将货物的保全义务与减少损失的义务进行对比,引用了ICC仲裁的相关案例,进一步深化对货物的保全义务的认识。

The study of the preservation of the goods obligation stipulated in the United Nations Convention on Contracts for the International Sale of Goods(1980)is meaningful both for International trade practice and its theory development.This essay can be divided into four parts.The first three clarify the contents of the preservation of the goods obligation after discussing the deficiency of the current research;the fourth part compares the mitigation the loss obligation with the preservation of the goods obligation and cites a case arbitrated by ICC so as to provide further insights into this obligation.
