摘要
随着我国劳动制度与人事制度改革的深化 ,劳动合同在现实中的作用越来越明显。无效劳动合同由于不具备法律效力 ,不能产生劳动合同双方当事人预期的法律后果 ,劳动合同的主体、劳动合同的内容、劳动合同双方当事人的意思表示、劳动合同的形式是判断无效劳动合同的依据。判断无效劳动合同 ,有利于在实践中避免、减少无效劳动合同的存在 ,保护劳动合同双方当事人的合法权益。
With the commitment to the deepening reform of labor and personnel systems, labor contracts play more practical role in reality. Invalid labor contract doesn't bear legal effectiveness, consequently it can't yield the result desired by the parties of both sides. An invalid labor contract can be determined by such factors as the entity, content, and types of a labor contract and the statement of the labor contract. The determination of an invalid labor contract will benefit the parties in the contract and protect their legal rights by avoiding the existence of invalid contracts and cutting down on the number of them.
