宋朝以赃致罪法略述

An Outline of Laws on Bribe and Stolen Goods in the Song Dynasty

宋朝的计赃论罪法 ,具有明显的因袭唐律的特征 ,但因唐宋社会的变迁 ,宋代的计赃论罪法亦发生了不同程度的变化。其变化趋向主要表现在对“强盗”、“窃盗”赃罪惩罚的趋于加重 ,对官吏贪赃罪处罚的由重趋轻 ,约“六赃”坐罪范围的扩大 ,征赃法、计赃法、平赃法的日趋完善。宋朝计赃论罪法的这些变化 ,亦展现出宋朝法律变化的时代特征。

Laws on bribe and stolen goods in the Song Dynaty had an evident character of following the Tang laws.But with the development of society,those laws also changed to different degrees.The changes are shown mainly by the more severe punishment on 'robbers' and 'thieves' and less severe punishment on corrupt officials.These changes of laws on bribe and stolen goods also exhibited the character of Song Dynasty laws.
