完善行政法基本原则的探讨

A Probe into Improving the Basic Principles of the Administrative Laws

行政法基本原则是行政法的精髓 ,在指导和统帅行政法的制定、实施等方面发挥着重要的作用。但目前行政法的基本原则没有真正体现行政法的本质特征 ,也没有反映出社会主义市场经济条件下行政法的新理念 ,因此有必要进一步探讨这一问题。行政法基本原则理应包含行政合法原则、程序正义原则、行政救济原则。

The basic principles of the administrative laws, as the quintessence, play an important role in guiding the formulating and implementation of the administrative laws, but it does not embody the essential characteristics of the administrative laws thoroughly as well as its new ideas under the condition of the socialist market economy. Thus the article undertakes to probe this issue and puts forward several principles that should be contained in the laws, such as legitimate administration, just legal procedure and administrative remedial measures.
