略论警察法律关系的内容构造

A Discussion on Content Composition of Police Legal Relations

既有研究对警察法律关系内容的认识基本上限于宽泛意义上的权力、权利、义务等,未加深入展开。借鉴现代法律关系学说,警察法律关系的内容构造可以分为权利与义务、权力与责任、权威与信赖等若干主要类型,每一类型下又包含多种内涵不同、定位各异的具体法律关系。警察法律关系内容构造的丰富、充实和细化,有助于警察法学理论体系的深入展开。

The Previous studies, with their knowledge of police legal relations contents basically confined to broad sense of power, rights and obligations, have not been profoundly expanded. In light of reference to the modern legal relations theory, contents composition of police legal relations fall into following major categories: rights and obligations, rights and responsibility, authority and trust, etc., each of which includes specific legal relation with different connotations and orientations. Diversified, substantial and detailed contents of police legal relations contribute to in-depth development of police legal theory system.
