Research on Expansion of Administrative Procuratorial Functions

检察机关承担法律监督职能,有助于控制国家权力,实现司法公正。相较于刑事检察监督职能,现有行政检察监督职能的制度设计有进一步拓宽的必要和可能。当前行政检察监督在法律配置上存在一定问题,需要从行政执法监督、行政诉讼监督范围和方式、行政抗诉、行政执行监督检察程序等方面,拓展行政检察监督职能。

Procuratorial organs assume legal supervision functions, contributing to control of state power and realization of judicial justice. Compared with criminal procuratorial supervision functions, it is necessary as well as possible for the system design of the existing administrative procuratorial functions to be further expanded.Due to problems in legal allocation of the present administrative procuratorial supervision functions, efforts need to be made to expand administrative procuratorial functions from the perspectives of administrative law enforcement supervision, the scope and means of administrative litigation supervision, administrative protest,administrative execution of supervision and procuratorial program, etc.
