论犯意转化与另起犯意、转化犯、吸收犯之关系

On the Relations between Transformed Crime Intention, Separate Mens Rea,Transformed Crime and Incorporate Crime

在刑法理论上,犯意转化、另起犯意与转化犯这三个易混法律术语的关系一直被忽视。从语言学以及刑法学的角度对这组概念进行辨析,找出犯意转化与另起犯意在犯意个数和性质、行为个数和性质以及犯罪的具体对象方面的不同,捋清犯意转化与转化犯属于对犯罪主观方面的片面评价与对犯罪的罪数形态的综合评价之对应关系,可以找到转化犯在罪数形态中应有的位置,也可以明确另起犯意所对应的罪数形态应当是实质的数罪。

In theory of criminal law, the relations between easily-confused legal terminologies like transformed crime intention, separated mens rea, and transformed crime has long been neglected. Differentiation and analysis is made on this group of terminologies from the perspective of linguistics and punishment law, which offers us the finding of the differences between transformed crime intention and separate mens rea in terms of the number and nature of crime intention, the number and nature of behavior and the specific crime object, explicit knowledge of the relations between one-sided evaluation of transformed crime intention and comprehensive evaluation of criminal crime number, the finding of the due position of transformed crime in the criminal crime number, and explicit knowledge that the criminal crime number on the part of separate mens rea should be the substantial crime number.
