摘要
公安机关对《治安管理处罚法》相关条款中"国家规定"的解释和答复,具体内容不尽相同。行政机关越权解释,其法律效力值得商榷。厘清"国家规定"与"国家有关规定"等不确定法律概念的具体内容,是完善法律文本的前提和基础。较之于《人民警察法》中"国家规定"使用次数较多、用语欠规范,《道路交通安全法》中相关条款则较为科学与完善。
The interpretations of the state provisions in Penalty Law of Public Security Management vary from one public security organization to another. The legal effect of unauthorized explanation on the part of administrative organizations is subject to discussions. Improvement of the legal law text is based on clarification of the concrete contents of undefined legal concepts such as the ' state provisions' and the 'relevant state provisions'. Compared with the state provisions in the Police Law, which are more frequently used with nonstandard expressions, the relevant provisions in China's Road Traffic Safety Law are comparatively scientific and perfect.
