论司法公信力的多重维度及其中国式构建

On Multi-dimensions of Judicial Credibility and the Chinese-style Construction of It

司法公信力是表征社会公众对司法公正性是否认同与尊重及认同与尊重的程度如何的一种心理状态。司法公信力内含客观与主观、内在与外在、过程与结果、应然与实然、正面与负面以及微观与宏观等多重维度。司法公信力的多重维度可以为当下中国司法公信力的提升提供借鉴,即全面而有重点地提升中国司法公信力。提升中国司法公信力的途径包括提升司法信用、培养理性公民、让司法与公众彼此接近。

Judicial credibility refers to the public psychological state representing their recognition and respect as well as the degree of their recognition and respect for judicial fairness. Judicial credibility contains multi-dimensions of objectivity and subjectivity, internality and externality, process and result, ideal and reality,positiveness and negativeness and microcosm and macrocosm. Multi-dimensions ofjudicial credibility can be of reference for a comprehensive improvement of Chinese judicial credibility. To be specific, Chinese judicial credibility can be improved through pomotion of the judicial justice and public credit, cultivation of rational citizens, and creation of closeness between the justice and the public.
