摘要
法国反邪教法全文并未对邪教进行概念界定,也未罗列认定邪教的具体标准,只是笼统地规定该部法律适用于所有追求对其内部成员精神征服的法律实体。该部法律的最大特点是并未创设新的罪名,基本上是对现有刑法和消费法等法律中已有罪名的重申和修订。即便没有该部法律,法国仍可根据现有法律治理邪教,但该法实现了对邪教处罚规定的集中和强化,以及对邪教组织的解散和对信教群众精神损害的救助。
France's anti-heresy law does not define the concept of heresy, nor does it list the specific standards for identification of heresy, but only gives general rules that the anti-heresy law apply to the legal entity, which is in pursuit of conquering its internal members spirits. The prominent feature of the law basically restates and revises the charges existing in the present criminal law and the consumption law, rather than creates new charges. France is capable of managing heresy in accordance with the present law even without this law, which, however, intensifies and centralizes the penalty provisions for heresy, and helps heresy organizations out of dissolution and religious believers out of mental injury.
