法科学生批判性思维培养和法学教育革新

On Cultivation of Law major Students' Critical Thinking and Innovation of Law Education

批判性思维是关于思维方式、思维能力和思维品质的训练。批判性思维训练有助于法律思维的培养。当前高校法科学生存在批判性思维缺失的现象。教育的失位和社会变革的负面影响是学生批判性思维缺失的原因所在。批判性思维的缺失直接导致法科学生法律思维的低下,急需法学教育的革新。这其中,批判性思维的培养可以看做是法学教育革新的一个切入点,以批判性思维为导向,从批判性思维培养的模式设计和具体方案等方面对高等法学教育革新做一次新的探索。

Critical thinking, involving training of thinking modes, thinking ability and thinking quality, contributes to cultivation of legal thinking. There exists in colleges and universities the law major students' lack of critical thinking,which is attributed to absence of education and negative impacts of social changes. Absence of education directly breeds low quality of law major students' legal thinking, which urgntly calls for innovation of law education.Innovation of law education can be initiated from cultivation of critical thinking as an entry point. The article attempts to make a critical thinking- oriented exploration on innovation of law education in colleges and universities from the perspectives of critical thinking cultivation mode design and specific programmes.
