论吸毒人员的权利保障存在的问题及成因

On the Problems in Rights Protection of Drug Addicts and Causes of Them

尽管吸毒是我国法律所打击的违法行为,但从人权保障的角度看,在我国宪法和法律中吸毒人员的权利与普通公民一致。现实生活中,吸毒人员因其违法行为被贴上"瘾君子"等标签而被社会所歧视和排斥,其应该享有的各种公民权利也经常被侵犯,难以得到有效的保障。究其原因,既有吸毒人员自身权利意识淡薄,也有社会性歧视、家庭温暖的缺失、法律执行力度薄弱等因素。

Drug taking is an offense against the law of our country, but seen from the perspective of human rights,China's constitution and law endows the drug addicts with the rights, which are in line with ordinary citizens'. In reality, the drug addicts are labeled as 'drug addicts'and other labels just because of their violations against law,resulting in their being discriminated and excluded by the society and their various civil rights being infringed. This is mainly attributed to the drug addicts' poor rights consciousness, social discrimination, lack of family warmth, weak law enforcement and so on.
