Research on the Value of the Effective Inquiry and Constituent Elements

询问是发现和查明犯罪的重要途径,通过询问获取的证人证言是证据的重要种类之一。当前侦查询问工作中还存在侦查人员缺乏询问技巧、证人不愿作证等问题,导致有效询问的效率较低。基于上述考虑,开展对有效询问的研究,在明确其内涵与结构、梳理其研究必要性的基础上,从询问人员、询问对象、询问程序、询问策略、询问方法和询问语言六个方面详细论述其构成要素,以期相关研究对询问乃至侦查提供有价值的思考。

Inquiry is an important way to detect cimes. The witness' s testimony is still an important kind of evidence.There are still some problems and difficulties in the current investigation and inquiry work, such as investigators' lack of inquiry skills, witnesses' reluctance to give evidence, resulting in low efficient inquiry. On the basis of these considerations, it is necessary to carry out the research on effective inquiry. Through clarifying the connotations and structure of inquiry, and sorting out the necessity of carrying out the research on the elements of effective inquiry, we discuss the constituent elements of effective inquiry from six aspects, namely, inquiry staff, inquiry object, inquiry procedure, inquiry strategy, inquiry method and language with a view to provide valuable reflections on the inquiry and investigations.
