广西实施综合行政执法程序规定的思考

On Implementing the Provisions of Comprehensive Administrative Law Enforcement Procedure in Guangxi

综合行政执法是地方治理的重要选择,亦为地方推进法治政府建设顺应实践的重要选择。广西实施综合行政执法在程序方面取得一定成绩,但也存在层级不高、内容相对滞后以及范围受限等不足,造成不利局面,原因主要归结于正当程序的理念贯彻以及制度彰显。广西在推进综合行政执法过程中应秉持程序正义的基本立场,立足行政正当程序的内在追求,结合自身实际构建综合行政执法程序方面的良性规则。

Comprehensive administrative law enforcement is an important choice of the local governance,as well as for local governments to promote the construction of the rule of law conforming to practice.Guangxi has made some achievements in the implementation of comprehensive administrative law enforcement.However,there are still a few problems,such as low levels,relatively outdated contents and limited scope of law enforcement,which results in certain unfavorable situation.This is mainly related to the implementation of the due procedure and the manifestation of the system.In the process to promote the comprehensive administrative law enforcement,Guangxi should uphold the basic stand of procedural justice and stick to the internal pursuit of due procedure of administration,so as to establish the benign rules of procedure for the comprehensive administrative law enforcement in line with its own reality.
