随着盗版的不断发展,民族音乐著作权保护受到逐渐重视。从纳普斯特公司、MP3公司判例出发,研究了美国民族音乐著作侵权法的相关规定,并在此基础上提出,我国应从加强民族音乐著作权的技术保护手段、界定我国民族音乐著作权的合理使用范围、实行民族音乐的强制授权与收费制度等方面完善民族音乐著作权保护法。

With the continuous development of piracy, The copyright of ethnic music has been attached great importance increasingly. From the Napster company,MP3. com company,we studied the relevant provisions of the American ethnic music works tort law. And on this basis,we proposed that China should strengthen the technical means of copyright protection of ethnic music, define the legitimate using scope of our ethnic music copyright, implement the compulsory licensing and charging system of ethnic music to improving China ethnic music copyright protection law.
