中国传统法文化的研究范围远比古代法宽泛。研究认为,中国古代法是'礼治'、'德治'、'人治''法治'等为内容的一种'综合体的法'[1]。与现代法律价值有一定的'相容性',如对善良风俗的倡导与维护、重'调节'、讲'和谐'、趋'合理'、求'公正'等思想,反映了法律在发挥其社会作用时所追求的理想和目的价值,对当今我国的法治建设具有重要影响和借鉴意义。

The research scope of Chinese traditional legal culture is far broader than ancient law.Studies show that the ancient law in China is a "complex act" of "rule" or "rule of virtue", "rule of man" and "rule of law".Between Chinese traditional legal culture and the value of modern law there is some "compatibility",like advocating and maintaining the morals,stressing on "adjusting",speaking of "harmony",pursuing "reasonableness" and "justice",which reflects the law in the pursuit of ideal and purpose with the development of social role and intrinsic value.There exit a significant impact on our country’s legal construction and reference significance.
