Intellectual property has become a critical issue for networked information and digital library construction. The case of Mr. Chen Xingliang s taking legal proceedings against Chinese Digital library Corp. , Ltd sets off our rethinking about the issue. The paper seeks to articulate a set of broad principles that can be used to guide legislation, judicial action and administration, including the harmonization of fairness and efficiency , protection of intellectual property and public interest, information public access and the principle of simplification of procedures.
