论违宪审查制度在我国的建立及模式选择

On the Establishment of Constitutional Review System in China and the Possible Mode

对法律的合宪性进行审查是法治的题中之义,为了保证宪法实施,必须建立相应的违宪审查制度。但是我国目前违宪审查的机构未能建立起来,相关程序问题也未得到解决,这与我国"依法治国"的发展进程是不相宜的。本文立足于挖掘我国现存阻碍建立违宪审查制度的因素,试图探索一种适合我国国情的模式。

It is the core of a legal system to supervise the constitutionality of a law, and in order to ensure the enforcement of a constitution, it is essential to establilsh a system of constitutional review. But now in China, no agency of this kind exists to review the constitutionality, and the relevant procedural problems still remain unsolved, which is incompatible with the China's progress of 'administering by law'. This paper, by searching for the barriers in this aspect, attempts to find out a mode which can go with China's conditions.
