略论民事诉讼中人民检察院的抗诉——兼论民事诉讼中再审程序的完善

民事诉讼中人民检察院的抗诉问题是民事诉讼法研究的一个重要问题。本文从人民检察院的抗诉条件、人民检察院抗诉的信息源、人民检察院在抗诉之审中的诉讼地位这三个方面进行剖析,同时对民事诉讼再审程序完善也提出一些富有建设性的观点。

Protest of the people’s procuratorate is an important issue in research on the civil procedural law. The article analyses the problem from three aspects: the conditions of the protest of the people’s procuratorate, the sources of information of the civil lawsuits, the procedure position of the people’s procuratorate in the trial of civil lawsuits, and put forwards some constructive views on perfection of retrial procedure in civil lawsuits.
