中国儒家文化是中国传统文化的主流。而儒家文化在政治领域始终倡导“德治” ,“法治”只是其辅政的手段。这一文化资源与西方“法治”传统构成对立的文化价值系统。总结对比中西“德治”与“法治”的根源及其现代意义 。

Confucian cultural of China is the dominant ideas of Chinese traditional culture.It advocates the rule of virtue in the political realm all along,while the rule of law is an auxilary measure only.Both Coufucian cultural resources and Western tradition of rule of law consist of the system of cultural differences.In this thesis,the author compares cultural origins and modern senses of Chinese legal cultures with those of the Western world.
