试析学校行政主体法律地位及其行为规范

Analysis of the Legal Status of Educational Institutions as Subject of Administration and Their Norm of Conduct

学校经过法律法规的特别授权而取得一定的行政职权 ,从而拥有行政主体资格 ,独立承担行政法律责任。因此 ,学校应规范自身的行为 ,依法行使法律赋予的行政职权 。

Educational institutions are endowed with certain administrative functions and powers through the special authorizatoin of the laws and regulations,and is therefore entitled with the qualification of subject of administration,which also means that they take on the legal responsibilities independently.As a result,educational institutions should strictly administer their affairs according to laws and regulations,practise their legal administrative authority in accordance with laws and regulations and refrain from abusing such functions and powers.
