认定商业秘密侵权行为有四种方法：（1）商业秘密的构成要件；（2）行人获取商业秘密的手段是否正当；（3）披露他人商业秘密是否非法；（4）使用他人商业秘密有无合法根据。

Whether an act is a business secret infringement can be judged according to the following aspects:1)the essential elements of business secret;2)whether the operator obtained other's business secret by legitimate means;3)whether it is illegal to leak others' business secret;4)whether the operator has lawful basis to use others' business secret.
