摘要
现行的司法实践中 ,动产适用善意取得制度。从维护不动产登记的公信力、保障不动产交易的安全与便捷、稳定社会经济秩序、完善善意取得制度四方面考虑 ,不动产也有适用善意取得制度的必要性。作为一种立法实践 ,不动产善意取得应符合五个要件 ,即 :存在依赖客体、转让人须为无处分权人、受让人通过法律上的交易行为从转让人处取得财产、受让人已经取得不动产的权利登记、受让人须善意。不动产善意取得的法律后果是物权变更和当事人之间的权利义务变化。
In the existing judicial practice,the personal property suits the bona fide aquisi- tion system.It is also necessary for the real estate to suitthe bona fide acquisition system in consideration of the following four aspects to maintain the public belief:to guarantee the safety and convenience ofthe real estate transaction,to stabilize the social ecnomic or- der and perfect the bona fide acquisition system.As a legislation practice,the real estate bona fide acquisition should meet the following five conditions:the existence depends on the object,the transferorshould be the person who has no rightto deal with the property; the transferee gets the property from the transferor through the lawful transaction,the transferee has already obtained the right register of the real estate and the transferee should have goodwill.The lawful results of the real estate bona fide acquisition are the property right change and the rightand obligation changes between the people involved.
