试论法律移植的主体

The Subjects of Transplantation of Law

本文在明确法律移植主体问题既是我国法制建设和社会发展的需要 ,也是法律移植秩序化和我国法律体系完整性要求的基础上 ,从狭义的法律移植角度和宽泛的法律移植角度对法律移植主体构成进行阐述 ,认为法律移植主体应依法拥有法律移植权 ,而法律移植权属于立法权的范畴 ,故法律移植主体应具有专属性。就我国法律移植的现状而言 ,我国应尽快在法律中明确法律移植权的归属 ,使法律移植主体合法化。

The paper makes it clear that the subjects in law transplantation is needed by legal system and social development in China ; It is asked by order of . transplantation of law and perfection of legal system. The paper makes clear the subjects of transplantation of law through a narrow sense of transplantation of law and a broad sense of transplantation of law. The paper states that the subjects of transplantation of law must be monopoly power because the subjects of transplantation of law must own the power of transplantation of law, and in fact , the power of transplantation of law belongs to legislative power. At present , it is pressing to make clear the subjects of transplantation of law, which will become legal and standardized.
