我国《刑法》第140条罪名为"生产、销售伪劣产品罪",但随着社会经济的发展,"生产、销售伪劣产品罪"中关于量刑尺度的"销售金额"规定灵活性不足,短板已经凸显,有违罪责性相适应原则和忽视了伪劣产品内涵不断演变客观事实。将生产、销售的行为系统分解,对伪劣产品进行准确的定义,有利于更为科学及严厉打击生产和销售伪劣产品犯罪行为。

It is quite clear that the Legislation of crimes of producing or selling fake and shoddy products is very important in criminal Law.The defects on the 'sales amount:in thecrimes are getting worseand worse with the development of social economy,such as contrary to the principle of attribution,ignoring the connotation of fake and shoddy products,and objective facts.Therefore,it is necessary to decompose production and sales behavior and define fake and shoddy products accurately.The purpose is to crack down the crimes of producing or selling fake behavior scientifically and strictly.
