摘要
为了促使河长制进一步制度化和规范化,使得河长在河流治理中的职权于法有据,针对河长制进行立法的必要性便由此彰显。通常而言,河长制立法有两种主要模式,一是对河长制进行专项立法;二是在其他立法中将河长制入法,此两种立法模式各具优劣,且在实践中均有采用。为了保证河长制立法的科学性与合理性,在对河长制进行立法时应当分析并解决相关的难点问题,包括合理确定河长制的立法层级,实现河长制立法与党内法规的协调衔接,处理好法律与政策的关系,以及科学安排河长与行政部门的职责。
In order to further institutionalize and legalize the river director system,and make the river director's duty in river management lawful,the necessity of river director system legislation is highlighted.Generally speaking,there are two main models for river director system legislation:one is to make special legislation on river director system;the other is to make river director system lawful in other legislation.These two legislative models have their own advantages and are adopted in practice.To ensure that the river director system legislation is scientific and rational,we should analyze and solve the related difficult problems first,including rationally determining the legislative level of river director system,realizing the coordination between legislation and inner party laws and regulations of river director system,handling the relationship between law and policy well and scientifically arranging the responsibilities of river directors and enforcement departments.
