Optimization of Judicial Auxiliary System in Countries Along “Belt and Road”

"一带一路"沿线国家司法辅助制度具有促进中国与沿线国家的国际司法合作、为"一带一路"倡议提供稳定的区域司法合作环境和为区域内企业合法权益提供可靠的司法保障等重要价值。然而,由于"一带一路"沿线国家区域政治经济文化的复杂性、区域司法辅助制度的多元性、较低的区域司法辅助国际合作水平,以及霸权主义国家的干扰和破坏等,"一带一路"沿线国家司法辅助制度仍然处于较低的发展水平。对此,需要从采取以求同存异、合作双赢作的原则为区域司法辅助制度构建的基础,以解决现实司法问题作为司法辅助区域合作的出发点,构建以若干核心国家为中心的次区域多边司法辅助合作试点,以及构建逐步推进的多元区域司法辅助合作机制等维度进行完善。

The judicial auxiliary system of the countries along“Belt and Road”has promoted the international judicial cooperation between China and the countries along the route.To provide a stable regional judicial cooperation environment for“Belt and Road”initiative and to provide reliable judicial protection for the legitimate rights and interests of regional enterprises.However,ue to the complexity of regional politics,economy and culture in the countries along“Belt and Road”,the pluralism of regional judicial auxiliary system,the low level of regional judicial auxiliary international cooperation,and the interference and destruction of hegemonic countries,etc.The judicial auxiliary system of the countries along Belt and Road is still in a low level of development.Therefore,it is necessary to take the principle of seeking common ground while reserving differences and win-win cooperation as the basis for the construction of the regional judicial auxiliary system,and to solve the actual judicial problems as the starting point of the regional cooperation.To construct a sub-regional multilateral judicial assistance cooperation pilot centered on several core countries,and to build a multi-regional judicial auxiliary cooperation mechanism.
